Privacy Policy – paripesa.co.za

1. General

The Bill of Rights under the Constitution of the Republic of South Africa, 1996 gives every person the right to privacy, including protection against infringement of the privacy of communications. The Protection of Personal Information Act 2013 (“POPIA”) gives effect to this constitutional right.

In compliance with POPIA, Ruby Bets (Pty) Ltd (the “Company”) informs users how it processes their Personal Information in this Privacy Policy.

2. Definitions

The definitions to key terms for the purpose of this policy are set out below:

  • Information Officer – the role assigned to a person responsible for promoting and overseeing the Company’s compliance with POPIA.
  • Operator – a person or entity that processes personal information for a responsible party under a contract or mandate without coming under that party’s direct authority.
  • Personal Information – information relating to an identifiable, living natural person. Personal Information can include, without limitation: name, race, gender, marital status, address, identity number, e-mail address, telephone number, location data, and online identifiers.
  • Processing – any operation or set of operations concerning personal information, whether or not by automated means, including collection, receipt, recording, organisation, collation, storage, updating or modification, retrieval, alteration, consultation or use, dissemination by transmission or distribution or making available in any other form, merging, linking, restriction, degradation, erasure, or destruction.
  • Responsible Party – a public or private body, or any other person which, alone or in conjunction with others, determines the purpose of and means for processing personal information.
    Services – the goods and services, including access to betting platforms and websites, promoted, offered, or provided by the Company.

3. Responsible Party

The Responsible Party is Ruby Bets (Pty) Ltd, registration number 2022/352837/07, with registered office at 14 Trinity Street, Bloubergstrand, 7441, operating online betting services under the brand paripesa.co.za, licensed under Licence No: 10193170-002.

4. Information We Collect

We collect Personal Information because (i) it is necessary to promote, offer, or supply our Services to you; and/or (ii) it helps us improve our Services. A full description of our purposes is provided in Section 5 (How We Use Your Information). You are not obliged to provide Personal Information, but much of it is essential to create and operate your account and to enable betting on our platforms. If you choose to withhold requested information, we may be unable to provide our Services.

During registration and when you subsequently use your account, you may be asked to provide, among other things:

  • first and last name;

These services check whether a device or method of payment has previously been used in fraudulent or abusive activity (e.g., identity theft, promotion abuse, or payment fraud).

5. How We Use Your Information

We use the information we collect to protect users and third parties, to provide, maintain, safeguard, and improve our Services, and to develop new Services. We may also offer tailored content, including more relevant promotional offers, where you have consented to receive marketing.

We process your Personal Information for the purposes of:

  • creating and managing your account;

  • contacting you via your registered details where necessary for account management and operations;
  • processing financial and wagering transactions online;

Where activity differs from ordinary and expected behaviour, we conduct further analysis and may exclude you from certain promotions or bets, in line with our Terms and Conditions. Examples of unusual betting behaviour include (without limitation):

  • significantly larger than expected bets on a very specific outcome (e.g., a precise set score in an ITF tennis match);
  • a bet placed by a customer who may have access to non-public information about an event’s likely outcome;
  • material changes to an established betting pattern;
  • an alert from a sport’s governing body or monitoring agency; and
  • a high volume of bets placed within a short period on one specific outcome.

Any analysis performed is a private business asset and is not transmitted to any third party. We reserve the right to apply restrictions to accounts where the Company considers it appropriate due to betting activity.

6. Who We Share Your Personal Information With

Certain trusted third parties provide essential services that enable us to offer gambling products. These include, without limitation:

  • suppliers of software and games used on our websites;
  • banking and payment service providers;
  • identity verification providers;
  • fraud-prevention and risk-management companies.

We share the information necessary for these parties to perform their services, and we take reasonable measures to ensure they implement appropriate security and privacy arrangements to protect your data.

To comply with regulatory obligations, we may be required to disclose information to government authorities (such as the police) or our regulators. Personal Information may also be shared with regulators, agencies, or relevant sports bodies where we suspect involvement in match-fixing or a breach of sporting regulations. We will also disclose information as required to enforce our Terms of Use as set out in our Terms and Conditions.

In the event of a sale of our business or a similar corporate transaction requiring transfer of Personal Information to a third party, we will notify you via e-mail or a notice on our websites, identifying the new Responsible Party and explaining your options regarding your Personal Information.

Our websites may contain links to and from third-party websites. Such websites may have their own privacy policies, and we accept no responsibility for them. Please review those policies carefully before submitting any Personal Information.

7. Marketing and Opting Out

The Company may process Personal Information for marketing purposes. In certain limited circumstances, we may also provide information to selected third-party partners to market our services to you, provided you have given consent.

When you create an account, we request your consent to receive marketing/promotional material. You can opt out at any time. Opting out does not affect the creation or operation of a gaming account, though it may affect eligibility for some promotional bonuses.

Even if you unsubscribe from marketing, we may continue to send periodic e-mails and/or SMS messages relating to technical, service, or security matters, confirmations of requests you made, or other communications we are legally obliged to send. You undertake to keep us informed of any changes or inaccuracies in your Personal Information.

Please note that objecting to our processing may prevent us from providing the Services and could lead to account closure. The above rights are not absolute: applicable law or regulatory requirements may allow or require us to refuse certain requests (for example, where data is needed to exercise or defend legal claims). In some cases, Personal Information may already have been destroyed, erased, or anonymised under our retention obligations and practices.

9. Cookie Policy

13. Minors

The Services are not intended for users under the age of 18. If you are under 18, you must not use the Services or provide any Personal Information. We reserve the right to verify Personal Information collected from you. If we become aware that a user under 18 has shared information with us, we will discard such information. If you believe a minor has provided information, please contact Customer Support using the contact details on our website.
